Annual Digital Site Licences - for Words on Screen™
Costing just £9.96 pa per title these replace Extension Licences and permit school-wide installation of Words on Screen™ software. 
(A Single-User Licence granting a single installation is supplied free of charge with Words on Screen™.)
Annual Digital Site licences are available for purchase online from the relevant songbook information page.

Performance Licences - for musicals and nativities
These grant permission for public performances as well as digital usage rights.
Performance Licences can be purchased directly from the relevant musical or nativity information page.

Licensing Summary:  Important - Read This Now

You are free to use any of our resources anywhere in the school for teaching purposes.

The public performance of a musical or nativity, ie to an audience other than pupils and staff, is permitted if you hold a valid Performance Licence from Out of the Ark Limited.

The public performance of songs (without the performance of a scripted drama) is permitted if you hold a valid PRS licence.

Making printed copies or photocopies of songbooks for use in the classroom is covered by your Schools Printed Music Licence (SPML) and Copyright Licensing Agency (CLA) licences.  You should report your usage when requested by the licence issuers.

Reproducing the lyrics of songs or projecting the lyrics of songs in assemblies and copying the music scores for use in assemblies are covered by your school's CWCL and CWMRL licences from CCLI.  You should report your usage to CCLI on your regular copy reports.

Limitied digital usage rights for software are granted by a Single-User Licence which is supplied to you when you purchase digital products.  This allows you for example to install software on one computer but NOT the network server.

More extensive digital usage, for example to install software on multiple computers or onto a network server, requires an annual Digital Site Licence (or, in the case of a musical or nativity, a Performance Licence).  Digital Site Licences and Performance Licences can be purchased from Out of the Ark Limited.  Please note that annual Digital Site Licences replace the Extension Licences that were formerly supplied by Out of the Ark Music.  However if you hold an Extension Licence this continues to be valid.

Performance Licence Options

The performance of a musical or nativity to an audience (other than pupils and staff) requires a performance licence, even if it's a 'free' performance, wherever in the world the performance takes place. (Please note a Performing Rights Society (PRS) Licence does NOT cover musicals and nativities). A performance licence is title-specific.

We issue affordable performance licences to schools, churches, nurseries and other groups which can be obtained in two ways:

A Standard Performance Licence.
This should be purchased if you already have the Book & CD or Book, CD & CD ROM for a product but did not buy a Performance Licence, or if you previously bought a licence that has now expired. You can purchase a Standard Licence online on the product page for your musical or nativity. Alternatively, you can apply, or re-apply for a licence, by completing the performance licence application form to be found in our musical and nativity play books and send it to our current address. Please note that the licence prices applicable are those shown on the up-to-date price list above and now cover a 12 month period. An Instant Performance Licence.

Rights Granted to Licensee

Either type of performance licence will permit the holder to:

  • Perform the musical or nativity during the licence period. The licence will cover any number of performances (free or charging) within a specified time (maximum 12 months from the date of purchase or date of first performance if earlier).
  • Play the audio tracks (either backing or vocal tracks) at the performance

 

Photocopying Rights

Photocopying of the published material is permitted under schools' copying licences issued by PML, CLA and CCLI.

UK state schools should report when requested any:

  - copying of the lyrics and music on their Schools Printed Music Licence (SPML) returns
  - copying of the script, teachers' notes & staging instructions on their Copyright Licensing Agency (CLA) returns 

Schools that do not have a CLA or SPML licence may under the terms of the Performance Licence:
  • Make up to 2 photocopies or printed copies of the script for learning purposes. Copies must be destroyed after the performance.
  • Make up to 2 photocopies or printed copies of the music score for use by participating musicians on the performance dates
  • Reproduce the song lyrics on printed paper, e.g. for programmes, to project the lyrics or to display the lyrics electronically, to make transparencies for overhead projection and to display the lyrics on a touchscreen, interactive whiteboard or other type of screen. The following credit should be included with the lyrics: 'Reproduced by kind permission © Out of the Ark Ltd'

If the songs are used in a school assembly then photocopying, printing, displaying or projecting the lyrics or music score are covered by the school's CCLI licences and should be logged and reported as required by CCLI..



Use of Digital Content

In addition, where digital copies of the product have been purchased, a number of digital usage rights are granted to the licence holder, including:

  • Copying CD audio tracks to multiple computers or a network server belonging to the licencee.
  • Installing Words on Screen™ v2 song files onto more than one computer.
  • Displaying Words on Screen™ v2 song lyrics during performances.
  • Burning copies of the audio CD or MP3 files onto CD (up to 3 copies).
  • Uploading digital content onto school's intranet or learning platform.
  • Uploading children's performances of the musical to public websites.

An Out of the Ark Performance Licence is required by customers worldwide, not just in the UK.

(2) Digital Site Licences

Digital Site Licences which can be purchased from Out of the Ark Limited grant a number of software usage rights to the licence holder beyond the scope of the Single-User Licence that is issued at the time of purchase of the software.  The licences grant the rights for a 12 month period and must be renewed if the software is to be used after that period beyond the scope of the Single-User Licence.  In the case of a musical or nativity similar digital rights are granted by the Performance Licence.

Please note that annual Digital Site Licences replace the software Extension Licences that were formerly supplied by Out of the Ark Music.  However if you hold an extension licence this continues to be valid..  

The follwing digital usage permissions are granted to the holder of a Digital Site Licence:

Use of Audio CDs
Burning additional copies of the tracks onto CD for use within the licence holder’s establishment (limit 3 copies)
Copying tracks to more than one computer belonging to the establishment
Copying tracks to the establishment’s network server for access via any device belonging to the establishment
Copying tracks to the establishment’s computer music library (eg iTunes)
Installing CD onto a teacher’s own computer at home for preparation purposes only
Usage of tracks on teacher’s personal / mobile devices at home for preparation purposes only
Please note that the playing of CD tracks during public performances requires a PRS licence

Use of CD ROMs – Words on Screen™ and Words on Screen™ v2 
Installing the CD ROM to more than one computer belonging to the establishment
Installing the CD ROM to the establishment’s network server for access via any device belonging to the establishment
Installing the CD ROM to a teacher’s own computer at home for preparation purposes only
Displaying the song lyrics during public concerts / performances
Please note that the playing of the audio files (songs or backing tracks) during public performances requires a PRS Licence
Please note that displaying the lyrics for use in assemblies or church requires a CCLI licence

Use of Downloaded Words on Screen™ v2 Songs
Downloading song files to more than one computer / device belonging to the establishment
Downloading song files to the establishment’s network for access via any device belonging to the establishment
Downloading song files to a teacher’s home computer or mobile device for preparation purposes only
Displaying the song lyrics during concerts / performances
Please note that the playing of the audio files (songs or backing tracks) during public performances requires a PRS Licence

Use of Streamed Words on Screen™ v2 Songs
Streaming the songs beyond the initial free period on multiple devices belonging to the establishment
Streaming the songs on a teacher’s home computer or mobile device for preparation purposes only
Displaying the song lyrics during concerts or performances - for best results we recommend downloading song files
Please note that the playing of the audio files (songs or backing tracks) during public performances requires a PRS Licence

Use of MP3s
Burning copies of MP3s onto CD for on-site use (limit 3 copies)
Saving MP3s to devices belonging to the establishment
Saving MP3s to the establishment’s network for access via any device belonging to the establishment
Copying MP3s to the establishment’s computer music library (eg iTunes)
Saving MP3s onto a teacher’s own computer at home for preparation purposes only
Using MP3s on teacher’s personal / mobile devices at home for preparation purposes only
Playing MP3s (songs or backing tracks) during concerts / performances
Please note that the playing of the audio files (songs or backing tracks) during public performances requires a PRS Licence

Use of PDFs
PDFs may be used for all teaching purposes
Printing and photocopying the music score or lyrics is covered by the school’s SPML licence (or overseas equivalent)
Printing and photocopying other parts of the songbooks are covered by the school’s CLA licence (or overseas equivalent)
Printing and photocopying the lyrics for use in assemblies or church are covered by CCLI licences
Printing and copying should be logged and reported as required by each of the licence issuers
Schools that do not have SPML, CLA or CCLI licences may print or photocopy up to two copies of the music score for performance or learning purposes under the terms of this Digital site Licence

School’s Intranet / Restricted Internet / Learning Platform
Installation and uploading of audio files and Words on Screen™ Original or Words on Screen™ v2 files / PDFs for use in school
Installation and uploading of audio files and Words on Screen™ Original or Words on Screen™ v2 files for use in performance
Uploading of audio or video files of children performing songs

Public Websites (including school’s website, YouTube, Facebook, Vimeo, SoundCloud etc)
Uploading of audio or video files of children performing songs (Out of the Ark must be credited, plus inbound link to outoftheark.com must be provided).
Please note that Out of the Ark’s original recordings may not be posted to public websites except as an accompaniment to the children singing.

Exclusions

(1) The following activities require other licences and are not covered by the Performance Licence (except as stated above):
Photocopying or printing any documents for use in assemblies (covered by CCLI licences)
Photocopying or copying any documents for other school uses (covered by CLA and SPML licences)
Displaying song lyrics in assemblies (covered by CCLI licences)
Production of a CD or DVD for distribution that includes the work in any form (covered by MCPS Licence)
Performance of the songs in a public venue (covered by PRS licences)
Performance of the work for broadcast (broadcaster to seek permission)

(2) The following activities are not permitted:
Uploading files to public internet sites (other than audio accompaniment for a children’s performance on the school’s public website as above)
File sharing with any other establishment or its employees or pupils
Usage by peripatetics
Burning copies of audio files onto CD for pupils’ home use
